Our policies
1. Offers
By accepting an offer from PulmoTec AG, the customer accepts the General Terms and Conditions. They form an integral part of the contract.
2. Billing
The prices listed at the time of the order are decisive for invoicing. Unless otherwise stated, the prices are exclusive of statutory value-added tax (VAT). For orders with a net value of less than CHF 300, postage and packaging will be charged additionally at CHF 16. If the order is less than 100.- goods value, a surcharge will be charged.
3. Orders placed
Orders placed are binding. Unless otherwise noted, there is no right of withdrawal. The same applies to the right of return. In the case of an explicitly granted right of return or withdrawal, the customer is entitled to return the ordered product within a period of 14 days at his own expense. After this period has expired, PulmoTec is no longer obliged to take back the goods. Damaged products or packaging will not be taken back.
4. Billing and Delivery
Delivery is by courier or by a PulmoTec AG employee to the delivery address specified by the customer. Deliveries from an order value of CHF 300 (excl. VAT) are usually free.
5. Representation and Guarantee
The warranty is excluded to the extent permitted by law. PulmoTec AG undertakes to remedy the defects in the product free of charge by repairing or replacing the product during the warranty period (this can be seen in the respective purchase invoice). Further warranty claims such as rescission (cancellation of the purchase contract due to defects in the purchased item) and reduction are excluded. Warranty claims for the defective product can only be asserted by prior written notification to PulmoTec AG.
Devices must always be returned to PulmoTec at their own expense (to be borne by the buyer). In any case, protective packaging must be selected for the return, which enables safe transport. After repair or replacement, the device/item will be returned to the customer at PulmoTec AG's expense.
If devices arrive at PulmoTec AG for the purpose of a warranty claim or repair, and PulmoTec AG cannot determine any faults or damage, they will be returned after consultation with the customer. An inspection fee of 60 to 120 + postage will be charged.
6. Passwords / Confidentiality
The customer is responsible for the confidentiality of the passwords in the online shop and web platform. The subscriber is prohibited from disclosing his password to third parties and thereby enabling unauthorized access to prices and conditions. PulmoTec AG reserves the right to block the password if several people try to access the web shop at the same time with the same password.
7. Warranty and Liability
In the event of claims, regardless of their legal basis, PulmoTec AG is only liable for damage caused by gross negligence or willful misconduct and which is within its area of responsibility. Liability for indirect damage and consequential damage is excluded. PulmoTec AG assumes no responsibility for errors that are not within its area of responsibility, namely faulty production or modifications by manufacturers. Texts and online offers are without guarantee. Spelling and printing errors do not oblige PulmoTec AG to conclude a contract. PulmoTec AG reserves the right to make price changes at any time, even without prior notice. This applies in particular to massive surcharges in the procurement market.
8. Dates and deadlines, delivery quantities
The offered and accepted delivery and delivery dates are met by us in the best possible way. They correspond to the available order capacities and the existing options for material procurement at the time of the order or order confirmation. In the case of goods deliveries, the definitive acceptance of the contract by our sub-suppliers remains reserved. The delivery or delivery period begins with the conclusion of the contract. The agreed delivery and delivery dates or deadlines can be extended or postponed in a reasonable manner without PulmoTec AG being entitled to claim damages.
